Clipcircle Terms and Conditions of Use

Welcome to Clipcircle ("the Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Clipcircle video sharing platform and related services. The Platform is operated by Hantropos S.r.l., a company with its operating office at Via Inganni 34, 20147 Milan (MI), Italy ("the Company"). By using the Platform, you agree to be bound by these Terms in full.

1. Scope of Service

Clipcircle provides services for uploading, sharing, viewing, and distributing video content, as well as social interaction and commenting features, similarly to other video sharing platforms.

2. Age Requirement

You represent that you are at least 18 years old, or the minimum age required by the laws of your country of residence. The Platform reserves the right to request age verification and to suspend or terminate accounts in case of violation.

3. Accounts and User Responsibilities

You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to provide accurate information and not to use the Platform for unlawful or infringing purposes.

4. User-Uploaded Content

You retain ownership of the rights in the original content you upload. By uploading, you grant the Platform a worldwide, non-exclusive, royalty-free, transferable license to host, reproduce, distribute, publicly display, and technically adapt the content for the purpose of providing the service. You warrant that you possess all necessary rights and that your content does not violate applicable laws, copyrights, trademarks, privacy, or other third-party rights.

5. Prohibited Conduct

You may not upload or share content that:

  • Incites violence, hatred, or discrimination;

  • Constitutes pornography, obscenity, or child exploitation;

  • Infringes third-party intellectual property rights;

  • Contains malware, spam, or deceptive practices;

  • Violates applicable European law, including the Digital Services Act (Regulation EU 2022/2065) and the GDPR (Regulation EU 2016/679).

6. Platform Intellectual Property

The Clipcircle name, logo, interface, source code, and graphical elements of the Platform are the exclusive property of the Company or its licensors and are protected by European and international intellectual property laws.

7. Suspension and Termination

The Company may suspend or terminate your account, remove content, or restrict access in the event of a violation of these Terms or applicable law, providing notice where required by European regulations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Platform. The Platform is provided "as is" and "as available", without warranties of uninterrupted service or error-free operation, to the extent permitted by European consumer protection law.

9. Indemnification

You agree to indemnify and hold harmless Hantropos S.r.l., its affiliates, directors, employees, and partners from any third-party claims, expenses, or demands, including legal fees, arising from your use or misuse of the Platform or your breach of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union and, where not otherwise provided, the laws of Italy. Any dispute arising out of or relating to these Terms or the use of the Platform shall be subject to the jurisdiction of the courts of Milan, Italy, without prejudice to any mandatory consumer protection provisions under applicable law.

11. Changes to the Terms

The Company reserves the right to modify these Terms at any time. Changes will be posted on the Platform and will take effect from the date of publication. Continued use of the service after publication constitutes acceptance of the changes.
